Immigration Alert: USCIS Eliminates Receipt Requirement for Certain H and L Adjustment Applicants Returning From Overseas Travel

Effective November 1, 2007, United States Citizenship and Immigration Services (USCIS) will no longer require H or L visa holders with pending I-485 Permanent Residence Applications (also known as ìadjustment of statusî applications) to present an original I-485 receipt notice when arriving back in the United States after traveling outside of the country. Until today, USCIS regulations required H or L visa holders who travel outside of the United States while their adjustments are pending to show the original receipt notice for the I-485 filing upon reentry to the United States. Those who failed to carry their original I-485 receipt notices risked ìabandoningî the pending I-485 application. While this regulation was seldom enforced, its existence in formal USCIS regulation caused many foreign nationals anxiety and concern.
